Terms of Service

1. Agreement to Terms

By accessing or using AlertOwl ("Service"), operated by Solarium Interactive ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

AlertOwl is an uptime monitoring and status page platform. The Service checks whether websites, APIs, or services are reachable, records historical uptime data, and allows you to publish a public status page for your users.

3. Account Registration

You must provide a valid email address and create a password to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must promptly notify us at hello@alertowl.io if you suspect unauthorized access.

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.

4. Acceptable Use

You may only monitor services, APIs, or websites that you own or have explicit permission to monitor. You may not use AlertOwl to:

• Monitor third-party services without authorization
• Conduct denial-of-service attacks or stress tests on external systems
• Circumvent rate limits or access controls of third-party services
• Transmit malware, spam, or illegal content via status page notifications
• Violate any applicable law or regulation

We reserve the right to suspend or terminate accounts that violate these terms without notice.

5. Subscription Plans and Billing

AlertOwl offers a Free plan and a paid Pro plan. Paid subscriptions are billed monthly in advance. All payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

You may cancel your subscription at any time through your billing settings. Cancellation takes effect at the end of the current billing period — you will retain access to Pro features until that date. We do not issue prorated refunds for partial billing periods.

We reserve the right to change plan pricing with at least 30 days' notice delivered to your registered email address.

6. Service Availability

We strive to provide a reliable monitoring service but do not guarantee 100% uptime of AlertOwl itself. The Service is provided "as is." We are not liable for missed alerts, delayed notifications, or any losses arising from service interruptions or inaccurate monitoring results.

7. Data and Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

You retain ownership of any data you provide. By using the Service, you grant us a limited license to store and process that data solely to provide the Service.

8. Intellectual Property

The AlertOwl name, logo, and software are owned by Solarium Interactive and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Solarium Interactive shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or business interruption, arising out of your use of or inability to use the Service.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

You may close your account at any time from your account settings. We may suspend or terminate your account at any time if you violate these Terms or if required by law. Upon termination, your data will be deleted in accordance with our data retention policy.

11. Changes to Terms

We may update these Terms from time to time. When we do, we will update the effective date above and notify you via email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Solarium Interactive is incorporated, without regard to conflict of law principles.
